Professional liability protection for staff

Some time ago, the Regulated Health Professions Act was amended to mandate individual malpractice coverage for every regulated health professional. That provision was never proclaimed in force, but the Minister of Health and Long-Term Care ordered all health care regulatory colleges to pass measures requiring their members to have liability protection.

Under the RCDSO contract with ENCON Insurance Managers, the definition of “Insured(s)” includes a member’s or health profession corporation’s employees, except those who have or are required by their governing body to have professional liability protection.

Therefore, any non-dentist regulated health professional in your practice is not eligible for PLP assistance. You should ensure that those employees have their own liability protection.
