Will PLP assist me if I am sued for an employee’s act or omission?

The short answer is yes. PLP assistance extends to members and their employees who are not regulated health professionals for their own acts and omissions, often referred to as direct liability.

Dentists and their health professions corporations are also entitled to assistance when they are sued for vicarious liability, i.e. for acts and omissions of their employees in rendering professional services on or behalf of members or their HPCs.

However, it is important that all employees in a dental practice who are regulated health professionals have their own professional liability protection in accordance with recent amendments to the Health Professions Procedural Code, since their policies would be expected to provide the first avenue of recovery for patients injured as a result of their actions.
